Orator charges proceedings were fraudulent. Joseph died without issue. Samuel Henderson of Monroe Co., John Henderson of Ala.; and Rosannah wife of Benj. R. Sands of Iowa are bros. and sister of Joseph. F.M. Johnston and Margaret A. and Scynthia Johnston (of Loudon Co. ) are nephew and neices by a dec'd sister, and Wm. Landrum a nonresident, is a grandson of Wm. Henderson who was a bro. to Joseph. 1872; wit. Samuel M. Johnston, 78, says Jospeh's mother was my fathers sister; that Joseph was of unsound mind and had violent attacks even to frighten his father and mother especially the former who lived a long time after the latter's death, and that Samuel Henderson, bro. to Joseph was the only one who could control him; Joseph's father died 18 or 20 yrs. ago, and Saml. took care of Joseph. 1873; wit, R.W. Hudson states that Sarah Caroline Pressley alias Henderson is now living with my present wife who was the widow of Aleck. Henderson, and she has lived with her ever since long before Joseph Henderson died; that he doesn't know whose child she is. Aleck was bro. to Joseph. 1872; wit. Samuel Henderson, 67, bro. to Joseph, states that Joseph was three or four yrs. older than he and that before Joseph died he lived with bro. Aleck. and Aleck. told him (Samuel) that he need not come to see Joseph that night and he did not go, and the next day found the Will was made; wit. Nancy Henderson, 66, is wife of Samuel. Will of Joseph Henderson is in another suit, and I copied it.

No.422) Filed 14 Apr. 1872. M.F. Johnson, Adm. of Emanuel Smith et al vs Robert Rider et al. Emanuel Smith was arrested by Federal Authorities last part of 1864, taken to prison in Knoxville where he died 29 Dec 1864. On 13 Apr 1864 Emanuel Smith made note to Alexander Rider for $100 under following circumstances; Rider claimed that James Smith, son of Emanuel, had taken a mule from him, said James being then connected with the Army, and a minor, and Rider claimed Emanuel was responsible, said claim being accompanied with threats of violence. One Joseph Divine who was in charge of a squad of men at Madisonville also sent word to Emanuel to pay or he would put him in prison, and Emanuel "knowing the desperate character of Divine and his men" gave the note. Complainant says James Smith did not take mule, and that Emanuel gave note under duress. The Complainants are, besides Johnson, Hiram Pearson and wife Sarah formerly Smith, James Smith, John Shadden and wife Martha formerly Smith, Nancy C. Smith, all of Monroe Co., Henderson Henson and wife Susan formerly Smith of Loudon Co., and Silas Pearson and wife Jane formerly Smith of Mo. Rider sued on note and took land. Alexander Rider's children; Robert R., Austin, Alexander, Saml. R., Elizabeth, Mary, Martha, Salina, Nancy Ann wife of Wm. Hunt, James, William, and Sarah wife of James Peck, all of Monroe Co. except last 3 of Iowa.

Charles F. was born 10 Dec 1842, six years to the day after Samuel.

Barratt formerly of Abbeville District, S.C. was killed at Sharpsburg Sep 1862 while a soldier in Confederate Army. He left Widow E.C. and four children: Irene C., John P., William P., and Flora P. now ife of T.E.H. McCroskey, all of Monroe Co. Mrs. E.C. Barratt and her bro. J.T. Parks were app. Adms. in Abbeville Dist. and served until Mar 1867 when Mrs. E.C. married W.A. Upton and the Barratts moved to Tenn. Upton took over charge of Barratt estate, having himself app. Adm. and also Gdn. The Wards named above owned negroes given them by their grandmother who was the widow of J.P. Barratt dec'd; they were respectively 5,7,9, and 11 when their mother married Upton; Flora Pauline Barratt McCroskey is full name, In S.C. Case the four children are given as Flora, Clifford, John and William. Wit. Stanmore Brooks in Abbeville Dist. is Grand Uncle of the Barratt children: two of the children are girls so Irene C. must be same as Clifford. Mrs. E.C. is Elizabeth C.
