CHANCERY BOOK 1824- 1845 State of Tennessee Monroe County Page 1 Be it remembered that on the second day of April 1830 I James Montgomery an acting Justice of the Peace for the County of Monroe aforesaid by virtue of the powers in one vested by the commission hereto prefixed to examine all witnesses whatsoever as will on behalf of Wm Hunter complainant as of Samuel Johnston respondent on either of them in a certain matter of controversy depending in the Chancery Court holden at Kingston in the in the County of Roane and state aforesaid did cause to come before me at my house in Monroe County John H Johnston aged about thirty eight as a witness on behalf of Samuel Johnston repondent in said cause and the said John H Johnston being duly sworn with the up lifted hand and cautioned by me to deposed the truth the hole truth and nothing but the truth deposeth and saith That some time before or about the time the first note that Samuel Johnston held on Wm Hunter became due Wm Hunter came to my fathers riding avery fine geldon my father wanted him to gave up the horse but he sd. Hunter refused to give up the horse as he had need of him and was doubtful wheather he would even get the land and proposed to give up the clame which my father agreed to take back if he would get it for him the said Hunter. 2d Stated it was in Kentucky and proposed giving him an order for it to wich proposel my father would not agree. Question by the Defendant 1st Do you believe the preasent complainen to be the same man that was at my house spoke of Ans I do believe him to be the same Question 1st by the complainen Are you or are you not a son of Samuel Johnston the preasent defendant in this cause Ans I pas for it Q2 by the same Were you at your fathers at the time you said I went to his house Ans I was at home Q3 by the same Did you pay good attention to the conversation that pasd between your father Samuel Johnston and me Ans I did as far as I heard Qeu 4th by the same Was or was not these notes that your father held on me given for a clame caled Coxes claim in the big bend of Tennessee Ans I heard my father say just now that it was 3 Question 5th by the same Do or do you not no that your father borrowed my great coat that morning I was their at your fathers house in Blount County Ans I do not Q 6th by the same Dou yo or do you not no that your father attempted to take that fine horse frome me by an atacment Ans I no that my father wanted the horse but do not no any thing about an atachment Q 7th by the same dou you or do ya not know that your father went from home that morning I was ther Ans I do not recollect wheather he did or did not Q 8th by the same has there or has there not been a number of years since you saw me at your fathers in Blount County that you never thought of this case Ans their was it was anumber of years that I never hear of you nor thought of the case Q 9th by the same What is the hole cause of you making they statements that you have made here to day saying you have not thought of the case for many years Ans because I was sworn to declare the hole truth 10th Q by the same is or is not the principle cause of you making the statements you have made here to day acause owed by abill being filed in the court of Chancery by William Hunter against your father Ans I under stood there was a bill and my father wished to have my eviedence John H Johnston (his signature) I certyfy that the foregoing deposition of John H Johnston was taken at my house in monroe County and that Wm Hunter the complainant and Samuel Johnston the defendant was both preasent and that it was taken in my own hand writing given under my hand and seal this 2d of April 1830 James Montgomery (his signature) Justice of the Peace for Monroe County Abill of Costs Justic fee $1 Sherriff fee for notic .50 cents Witness 25 cents (This is about a gelding horse but the clerk evidently does not know how to spell.
