ROANE COUNTY TENN. CHANCERY BOOK 1824- 1845 State of Tennessee Monroe County Be it remembered that on the seventh day of March 1830 I George Selvidge one of the acting Justice of the Peas for the County of Monroe aforesaid by virtue of the power in me vested by the Commission hereto prefixed to examine all witnesses whatsoever as will on behalf of William Hunter Complainant as of Samuel Johnston Repondent on either of them in a certain matter of controversy. Depending in the Chancery Court holden at Kingston in the County of Roane and State aforesaid did cause to come before me at the house of John Keyes in Monroe County Benjamin Parker aged about fifty one years and Edward Harte aged forty eight years and Samuel P Boles aged about forty years and Micajah Carter aged about twenty six and Thomas Mccray aged about forty nine and Thomas hunt aged about forty years as witnesses on behalf of William Hunter Complainant in said cause and the said Benjamin Parker and Edward Hart and Samuel P Boles and Micajah Carter and Thomas Mccray and Thomas Hunt Being duly sworn on the Holy Evangelist of almighty God and cautioned to me to depose the truth the whole truth and nothing but the truth. Deposeth and sayeth that on the 17 day of the month of October in the year of our Lord 1827 Samuel Johnston came to my house and asked me if William Hunter had stayed with me thur over knight I told him he did He then asked me whitch way he had gon and how long he had bin gon and where he intended to stay that knight I told him he Hunter told me he intended to stay at Andrew James s in Mcminn County I then askedJohnston whate was the mater is Hunter owning you any thing Johnston said that Hunter did ow him a (?) I then asked him how much he told me Hunter owned him six or seven hundred dollars whitch has him running on interest about twenty one years whitch is now about twelve or thirteen hundred I then asked Johnston how Hunter com to ow him so much Johnston said he sold Hunter a peas of land and Hunter sold the land and cleared out with the pay or property so that he never could get his pay out of Hunter _____________ 1. question by the Justice of the peas what age are you? answer fifty one as near I can asertian 2. question by Complainant had you and Johnston any conversation about this sining deed to Hunter and if so what was it? answer Som time after in a conversation with Johnston he told me he never sold Hunter any land but his father did I told Johnston that Hunter had a very strong deed against him and his father and he was the furste that sind the deed He then said he never sind the deed as he knowd of but Hunter did not like to trad unless he wold sind the deed and he might a sinded it to pleas him 3. question by the complainant was you present when Johnston the present defendant showed to Moses G Wilson the mare I Road from your hous when I stayed all knight with you in October 1827 and if you heard the conversation and what was it answer I was present when Johnston showed wilson the mare that Hunter Rod from my hous and heard Johnston tell wilson that he got the mare of Hunter 4. question by complainant did you ever hear Johnston the present defendant use the name of John Johnston his father to screen(?) himself from responcilbility to the sd Hunter until after a suit was brought by Hunter against Johnston---- answer I did not until after he was suid and talk of his being suid 5. question by defendant did you know at the time we had the conversation that thare would be a suit brought me by Hunter or had you any knowledge that J Johnston knew it answer from other conversation me and Johnston had I beleave he Johnston had knowledg of it and further this desponant sayeth not Benjamin Parker (his signature) (By Jerry L.
